Terms of Service

1. Educational Use Only

The service is designed for personal study and test-preparation practice. It does not provide official CASPer® questions, official scoring, admissions advice, legal advice, medical advice, psychological advice, or a guarantee that you will receive a higher score, admission, interview selection, official score, or other test outcome.

2. Accounts and Eligibility

You must provide accurate account information and keep your sign-in credentials secure. You are responsible for activity under your account. You may not share, sell, rent, transfer, or lend your account access to another person. We may suspend or terminate accounts that appear fraudulent, abusive, shared, automated, or otherwise inconsistent with these Terms.

You must be at least 17 years old to use the service. If you are under 18, you must have permission from a parent or legal guardian where required by the laws that apply to you, including to use the service and enter these Terms.

3. Plans, Billing, and Access

Paid memberships are processed by Stripe. CASPer Prep Test 14 days, Max 1, Max 2, and Max 3 are one-off fixed-duration memberships that provide access for the stated period. Membership features, fair-use limits, and prices are shown on the pricing page and may change for future purchases.

When a fixed-duration membership ends, paid access automatically reverts to free access unless you renew or purchase another plan. Your account and saved practice data remain available subject to our Privacy Policy and any applicable retention obligations.

You authorize Stripe and our payment providers to charge the payment method you provide for the one-off purchase, applicable taxes, and other charges you expressly approve. These plans do not automatically renew. If you want additional access after a plan expires or its limits are reached, you must choose and purchase another plan.

If a payment fails, is disputed, is reversed, or appears fraudulent, we may pause, downgrade, or terminate paid access, subject to applicable law and any remedy or notice rights that apply. If you reach the fair-use limits for your membership, you may choose to purchase another membership to continue using paid critique features.

Nothing in these Terms limits non-excludable consumer guarantees, statutory remedies, or mandatory rights that apply in your location, including under Australian, New Zealand, United Kingdom, Canadian, United States, or other applicable consumer protection laws.

4. Membership Access and Fair Use

Timed practice, AI critique, full mock tests, and the complete scenario library require an active paid plan. Creating multiple accounts, using multiple devices to evade fair-use limits, masking identity, sharing accounts, or otherwise attempting to bypass membership limits is not permitted. We may retain account and device signals as needed to enforce this rule, as described in our Privacy Policy.

5. Refunds and Outcome Disclaimer

If you have a question or concern about a purchase, contact hello@ioi.net.au with the account email, membership purchased, purchase date, and relevant details. We assess refund and other remedy requests fairly under the law that applies to your purchase, including applicable consumer guarantees, statutory remedies, and any rights that apply to digital content or services.

Where no mandatory refund or other remedy applies, we may consider a change-of-mind request in light of access used, scenarios opened, critiques generated, videos submitted, and any suspected misuse. We do not charge a processing fee or deduct a fee from a refund that is required by applicable law. Nothing in this section limits a chargeback or other non-waivable consumer right.

Because plans provide immediate access to digital content and AI critique, you acknowledge that content may be available for use as soon as payment is completed. Any mandatory cooling-off, refund, chargeback, or consumer-law rights in your location still apply where they cannot legally be excluded.

6. Practice Content and AI Critique

AI critique, scores, quartile estimates, transcripts, practice plans, and recommendations are educational estimates only. They may be incomplete, inaccurate, or different from how an official evaluator would score an answer. You are responsible for reviewing, editing, and applying feedback with your own judgment.

You must not submit content that is illegal, harmful, defamatory, infringing, hateful, harassing, sexually explicit, exploitative, or that includes confidential information you are not permitted to share. You should not include real patient data, protected health information, school records, employer secrets, or identifying information about others in practice answers.

7. Community and Feedback Features

If you post in community areas or submit feedback, you are responsible for what you submit. We may remove, edit, hide, or restrict content that violates these Terms, creates risk for other users, or undermines the service. Do not post official test content, confidential application material, personal attacks, spam, or misleading claims.

8. Intellectual Property

The site, design, software, scenarios, explanations, frameworks, scoring rubrics, generated study workflows, and other service materials are owned by us or our licensors and are protected by intellectual property laws. You receive a limited, personal, non-exclusive, non-transferable right to use the service for your own preparation.

You may not copy, scrape, redistribute, publish, resell, train competing systems on, reverse engineer, or create derivative databases from the service or its scenario library without written permission.

9. Your Content

You keep ownership of the answers, recordings, transcripts, reflections, forum posts, and feedback you submit. You grant us a worldwide, non-exclusive license to host, process, display, analyze, transcribe, and use your content as needed to operate, secure, improve, and support the service, including generating AI feedback and enforcing plan limits. This license ends when your content is deleted from our active systems, except for backups, legal records, security logs, and de-identified or aggregated data.

Your profile details, CASPer test date, target courses, previous result quartiles, practice answers, recordings, transcripts, and critique are handled under the Privacy Policy. We do not send these details to Acuity Insights, universities, schools, or admissions programs.

10. Prohibited Conduct

You must not:

• share accounts or bypass plan, quota, or access controls;
• copy, scrape, bulk download, or redistribute scenario content;
• attempt to interfere with, probe, or disrupt the service or its infrastructure;
• use bots, automation, or credential stuffing against the service;
• submit malicious code, spam, deceptive content, or unlawful material;
• misrepresent our relationship with Acuity Insights or any admissions program;
• use the service to cheat on an official exam or reproduce official test content; or
• violate applicable law or another person's rights.

11. Availability and Changes

We aim to keep the service reliable, but we do not guarantee uninterrupted, error-free, or permanent access. We may update, suspend, limit, or discontinue features, scenarios, plans, pricing, and integrations. Changes to prices apply only to future purchases. We will provide reasonable notice of material changes where practicable, except where an immediate change is reasonably required for security, legal, fraud-prevention, or operational reasons.

12. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, CASPer the Test Prep and its owners, operators, contractors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, admissions outcomes, or test results. Any limitation in these Terms does not exclude or limit liability that cannot lawfully be excluded or limited, including applicable consumer guarantees, statutory remedies, fraud, wilful misconduct, or liability for death or personal injury caused by negligence. Subject to those limits, our total liability for a claim relating to the service will not exceed the amount you paid for the affected plan.

14. Indemnity

You agree to defend, indemnify, and hold harmless CASPer the Test Prep and its owners, operators, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising from your content, your misuse of the service, your violation of these Terms, or your violation of law or another person's rights.

15. Termination

You may stop using the service at any time. We may suspend or terminate access if we believe you violated these Terms, created risk, failed to pay, attempted to bypass membership limits, infringed intellectual property, or harmed the service or other users. Sections that by their nature should survive termination will continue to apply.

We may suspend or terminate an account for a material breach of these Terms, fraud, unlawful use, security risk, non-payment, or conduct that materially harms the service or other users. Where appropriate, we will give notice and a reasonable opportunity to remedy the issue. We may act immediately where reasonably necessary to protect users, the service, or our legal obligations. If we terminate a paid plan without cause before its stated access period ends, we will provide any refund or other remedy required by applicable law. Account content is handled under our Privacy Policy and applicable retention obligations.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law rules, unless mandatory consumer laws in your location require otherwise. Courts located in Queensland, Australia will have non-exclusive jurisdiction over disputes arising from these Terms.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new last-updated date. Continued use of the service after changes take effect means you accept the updated Terms.
